1. Introduction These Terms and Conditions govern your use of the Rafterburn Art LLC website and the purchase of any products from my shop. By accessing this site or purchasing art, you agree to be bound by these terms.
My newsletter service is hosted by Substack. By subscribing to the newsletter, you acknowledge that your use of that specific service is governed by Substack's Terms of Use (https://substack.com/tos).
2. Intellectual Property (Copyright) All content on this website, including but not limited to artwork images, text, logos, and graphics, is the intellectual property of Rafterburn Art LLC.
You may not: Reproduce, distribute, modify, or sell any of my images without express written permission.
You may not: Use my artwork for commercial purposes or AI training.
Ownership: Purchasing an original painting or print does not transfer the copyright to you. You own the physical object, but Rafterburn Art LLC retains all rights to the image itself.
3. Product Descriptions and Colors I make every effort to display the colors and textures of my artwork as accurately as possible. However, because computer monitors and phone screens vary, I cannot guarantee that your monitor's display of any color will be completely accurate. All sizes and dimensions provided are approximate.
4. Presentation & Framing Policy
Virtual Representation: All frames displayed on this website are high-resolution digital mockups intended to demonstrate the intended "Sovereign" presentation. These represent a professional floater frame style.
Post-Purchase Installation: To ensure the highest level of customization and transit safety, each work is custom-framed only after the purchase is finalized.
Consultation Period: Within 48 hours of purchase, the artist will initiate a personal consultation with the collector to select the ideal floater frame (e.g., Natural Wood, Matte Black, or Gold Leaf) to best suit the collector’s environment.
Minor Variations: As each frame is hand-selected and crafted from natural materials, slight variations in grain and finish may occur.
Ready-to-Hang Delivery: Every work in the Cavapoo Traveler series arrives custom-framed and professionally wired, meeting "Gallery Standard" for immediate installation.
4. Purchases and Payment We reserve the right to refuse any order you place with us. Prices for products are subject to change without notice. Payments are processed securely through third-party providers, and we do not store your financial details.
5. Shipping and Delivery
Processing Time: Please allow [Number, e.g., 3-5] days for your order to be packed and shipped.
Risk of Loss: Once I hand the package to the carrier (USPS/UPS/FedEx), the risk of loss transfers to the buyer. However, I insure all original artwork shipments.
International Buyers: You are responsible for any customs and import taxes that may apply. I am not responsible for delays due to customs.
6. Returns & Damage: The Collector’s Guarantee
1. Finality of Acquisition All Rafterburn editions and series are a unique, high-value artifact of the artist’s "Internal Madness" and staging process. Due to the bespoke nature of these editions and the personalized framing consultation provided with each sale, all acquisitions are final. We do not offer returns or exchanges for a change of preference.
Transit Protection & Insurance Your investment is fully protected from the studio to your door. Every shipment is covered by specialized third-party fine art insurance for the full appraised value.
In the Event of Transit Damage While our packaging procedures meet the highest gallery standards, should an item arrive with damage to the frame or the sculptural impasto, we provide a White-Glove Resolution:
Notification: The Collector must notify the studio and provide photographic evidence of the damage and all original packaging within 24 hours of the signed delivery.
The Collector’s Choice: Once the insurance claim is initiated, the Collector will be offered two "Sovereign" paths:
A Full Financial Refund: A complete return of the purchase price once the claim is processed.
Commission of a Legacy Replacement: The artist will prioritize the creation of a new, original work of equal value and theme to replace the damaged artifact.
Responsibility of Possession Upon a successful, undamaged delivery and signature, the responsibility for the care and preservation of the work transfers to the Collector. The artist is not liable for damage occurring after the item has been safely installed in its new environment.
7. Returns and Refunds
Original Art: All sales of original artwork are final.
Prints/Merch: If an item arrives damaged, please contact me at rafterburnart@gmail.com within 48 hours of delivery with photos of the damage to arrange a replacement.
8. Limitation of Liability Rafterburn Art LLC shall not be liable for any indirect, incidental, or consequential damages arising from your use of this site or purchase of products.
9. Governing Law These Terms shall be governed by and construed in accordance with the laws of the State of South Dakota, without regard to its conflict of law provisions.
